The Federation Council of Russia ratifies the MEDICRIME Convention

Russian senators have approved the Federal Law “On ratification of the Council of Europe Convention on the counterfeiting of medical products and similar crimes involving threats to public health” (MEDICRIME Convention).

The law provides for the mechanisms to protect the rights of victims and develop the cooperation in the area of combating the counterfeiting of medical products at the state and inter-state levels.

The Federal Law proposes to ratify the Convention with three statements. In its first statement, the Russian Federation declares that it will prosecute foreign citizens and stateless persons permanently residing on its territory only in cases established by the Criminal Code of the Russian Federation.

The second statement stipulates that, in the absence of a treaty on extradition or legal assistance, the Russian Federation will, on the basis of reciprocity, consider the Convention as the legal grounds for cooperation with other Parties on the issues of extradition and legal assistance in accordance with the laws of the Russian Federation with regard to the offences specified in the Convention, including in order to prosecute the legal entities.

By its third statement, the Russian Federation appoints the Federal Service for Surveillance in Healthcare as the national contact point responsible for sending and receiving the requests for information and/or cooperation in the area of combating the counterfeiting of medical products and similar crimes involving threats to public health.
